TERMS OF USE
Terms and Conditions for Virtual School Leadership One-on-One Sessions ("Coaching Services"), Group Coaching sessions, Online Collaborative Platforms, School Leadership Courses and Related Services.
Effective Date: 01/01/2025
These Terms and Conditions ("Agreement") govern the coaching relationship between the undersigned client ("Client") and Austin Synergy Innovations LLC., dba. Jami Austin Coaching ("Coach"), for virtual school leadership one-on-one coaching sessions ("Coaching Services"), group coaching sessions, online collaborative platforms, school leadership courses and related services. By booking and participating in the sessions, platforms and training, the Client agrees to the following terms:
1. Coaching Services
The Coach will provide personalized one-on-one virtual coaching sessions to the Client, focusing on leadership development, professional achievement, work-life balance, self-care, goal-setting, and fostering a positive school culture.
2. Session Scheduling & Duration

Session Frequency: Coaching sessions will occur [weekly/bi-weekly/monthly] as agreed upon by both the Coach and Client.

Session Duration: Each session will be approximately [55 minutes] in length, conducted via [Zoom], or another mutually agreed-upon platform.

Scheduling: Sessions must be scheduled at least [24-48 hours] in advance through [jamiaustincoaching.com].

Rescheduling & Cancellations: If the Client needs to reschedule or cancel a session, they must provide at least [24 hours] notice. Cancellations or rescheduling within [24 hours] of the session will incur a [full session fee/no refund].
3. Fees & Payment

Coaching Package: The Client agrees to pay the agreed-upon rate for the coaching package selected. Payment must be made in full prior to the first session, or as outlined in the payment plan.

Payment Methods: Payments can be made via [credit card, bank transfer, PayPal, etc.]. All payments are non-refundable unless otherwise stated in writing by the Coach.

Late Payments: Any late payments will be subject to a [late fee] of [$50] or [10%] after [10 days] past the due date.
4. Confidentiality
The Coach agrees to maintain the confidentiality of all information shared by the Client during coaching sessions. Any personal, professional, or educational information disclosed will not be shared with any third parties unless required by law or with the Client’s written consent. The Client also agrees to respect the confidentiality of any sensitive information shared by the Coach.
5. Client Responsibilities

Active Participation: The Client agrees to actively engage in the coaching process, complete any assigned exercises or reflection activities, and communicate openly with the Coach about their goals and challenges.

Timeliness: The Client agrees to be punctual for scheduled sessions. If the Client is more than [15 minutes] late to a session, the session will be canceled, and no refund will be issued.
6. Coach’s Responsibilities

Professionalism: The Coach will provide coaching services with care, integrity, and professionalism, using techniques and approaches that are in alignment with best practices in leadership development and well-being.

Availability: The Coach will be available for scheduled sessions and will communicate any unavoidable delays or cancellations with the Client in a timely manner.
7. No Guarantees
While the Coach will make every effort to help the Client achieve their professional and personal goals, the Client understands that coaching is a collaborative process, and results are not guaranteed. The Client acknowledges that success depends on their commitment, effort, and openness to the coaching process.
8. Limitation of Liability
The Coach is not responsible for any direct or indirect outcomes, consequences, or damages resulting from the Client’s decisions, actions, or inactions related to the coaching sessions. The Client is solely responsible for their own choices, behaviors, and actions.
9. Termination of Agreement
Either the Client or the Coach may terminate this agreement at any time with written notice. If the Client decides to terminate the coaching relationship before completing a pre-paid package, no refunds will be issued for unused sessions, except at the discretion of the Coach.
10. Intellectual Property
All coaching materials, including worksheets, templates, and resources provided by the Coach during the sessions, are the intellectual property of the Coach. These materials are for the Client’s personal use only and may not be shared, reproduced, or redistributed without the Coach's permission.
11. Technical Requirements
The Client agrees to ensure they have the necessary technology and equipment (internet connection, camera, microphone, etc.) to participate in virtual coaching sessions. The Client is responsible for resolving any technical issues that may arise during a session.
12. Force Majeure
Neither the Coach nor the Client will be held liable for any failure to perform their obligations under this Agreement due to circumstances beyond their control, including but not limited to natural disasters, government restrictions, or technological failures.
13. Amendments
The Coach reserves the right to update or amend these Terms and Conditions at any time. The Client will be notified of any changes, and continued participation in coaching sessions constitutes acceptance of the updated terms.
14. Governing Law
This Agreement will be governed by and construed in accordance with the laws of [Washoe County, Nevada, USA]. Any legal action or dispute related to this Agreement shall be subject to the jurisdiction of [Washoe County, NV, USA].
